ExamWise Terms of Service

Welcome to ExamWise. These Terms of Service apply to the ExamWise website and iOS App (collectively, the "Service"). Please read the following terms and conditions carefully. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By using the ExamWise Service (including the website and iOS App), you agree to these Terms. If you are using the Service on behalf of an organization or entity (such as your employer or educational institution), you represent that you have the authority to bind that organization or entity to these Terms. If you do not have such authority, or if you do not agree to these Terms, you must not use the Service.

2. Service Description

ExamWise is a learning platform designed for candidates preparing for Taiwan's national examinations, offering the following main features:

  • Practice Questions: Practice and testing features for past examination questions, including categorized practice and mock exams
  • Knowledge Cards: Structured knowledge organization for key exam concepts
  • AI Visual Explanations: Using AI technology to generate visual explanations for questions, helping to understand complex concepts
  • Learning Tracking: Recording learning progress, answer accuracy, and providing personalized learning analytics
  • Subscription Features: Offering free basic features and paid premium features

We may from time to time adjust, update, or discontinue certain service features, and will notify users in advance whenever possible.

3. Changes to Terms

We reserve the right to modify these Terms at any time. The modified Terms will take effect immediately upon posting. Your continued use of the Service will be deemed acceptance of the modified Terms. We will notify you of any significant changes via email or service notification. It is your responsibility to review these Terms regularly.

4. Account Responsibilities

ExamWise offers the following account types:

  • Registered Account: Account created by signing in with Google or Apple ID, with cross-device data synchronization
  • Guest Account: Account usable without registration, with limited features and restricted to a single device (see Section 5)

If you use this Service, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to comply with this requirement.

You agree to provide accurate, current, and complete information, and to update it promptly when your information changes. You agree not to impersonate any person or entity, or falsely represent your relationship with any person or entity.

5. Guest Account Terms

When using a guest account, you understand and agree to the following terms:

  • Feature Limitations: Guest accounts can only use some basic features; premium features (such as AI visual explanations, full question bank access, etc.) require registration and subscription
  • Device Binding: Guest accounts are bound to your device and cannot be used on other devices
  • Non-Transferable: Guest account data (including learning progress, bookmarks, etc.) cannot be transferred to other devices or merged into a registered account
  • Data Risk: Uninstalling the App or resetting the device may result in permanent loss of guest account data; ExamWise assumes no responsibility for this

6. Privacy Policy

Our Privacy Policy describes how we collect, use, and share your personal information. By using our Service, you agree to our handling of your data as described in the Privacy Policy.

7. Subscription Terms

ExamWise offers subscription-based premium features. Subscription terms are as follows:

  • Subscription Plans: ExamWise currently offers three subscription plans: 15 days, 30 days, and 60 days. Prices for each plan are as listed on the App Store page
  • Non-Auto-Renewable: All subscription plans are non-auto-renewable. After subscription expires, premium features will stop working, and you need to manually repurchase to continue using them
  • Subscription Period: After purchase, you can use all premium features during the subscription period until expiration
  • Price Changes: We reserve the right to adjust subscription prices. Price changes will apply to newly purchased subscriptions after announcement; existing subscriptions are not affected
  • No Refunds: No refunds are provided after subscription purchase. In special cases, refund requests must be processed through Apple's standard refund process (see Section 8)

8. Refund Policy

All subscription payments for the ExamWise iOS App are processed through Apple's App Store. Regarding refunds, please note the following:

  • All refund requests must be processed through Apple's standard refund process
  • You can go to Apple's refund page (reportaproblem.apple.com) to request a refund
  • Approval or denial of refunds is determined by Apple according to its refund policy; ExamWise cannot directly process refunds
  • If you have payment-related questions, you can also contact Apple Support

9. Account Deletion

You have the right to request deletion of your account at any time. Regarding account deletion, please note the following:

  • Deletion Method: You can delete your account directly in the iOS App under "Settings" > "Account Management", or send an email to support@examwise.app to request deletion
  • Subscription Benefits: After account deletion, even if your subscription has not expired, you will no longer be able to use premium features, and purchased subscription days will not be refunded
  • Data Processing: Your personal information and bookmarked data will be completely deleted; past answer records will be anonymized and retained for question difficulty analysis and learning experience optimization (see Privacy Policy Section 12)
  • Fresh Start: If you sign in again, it will be a fresh account, and previous data will not be restored
  • Irreversible Operation: Account deletion is irreversible

10. User Content

You understand that by using the Service, you may encounter content from various sources, and ExamWise is not responsible for the accuracy, usefulness, safety, or intellectual property of such content. You understand and agree that you use the Service entirely at your own risk.

You are solely responsible for any content you create, transmit, or display and for any actions you take through the Service, and you bear all consequences.

11. AI-Generated Content Disclaimer

ExamWise uses AI technology (including Google Gemini API and OpenAI API) to generate explanation content for questions, including text explanations, detailed question explanations, and visual explanations. The generation process combines web search tools to collect data and cross-references multiple sources to improve quality, but when using AI-generated content, you should note the following:

  • For Reference Only: AI-generated visual explanations are for learning reference only and do not constitute professional advice or official answers
  • May Contain Errors: Despite our efforts to ensure quality, AI-generated content may still contain errors, inaccuracies, or outdated information
  • Cross-Reference with Authoritative Sources: We recommend comparing AI-generated explanations with textbooks, official materials, and other authoritative sources; you should not rely solely on AI-generated content as your only learning resource
  • Error Reporting: If you discover errors or inaccuracies in AI-generated content, you can notify us through the error reporting feature in the App, and we will do our best to improve
  • Disclaimer: ExamWise is not liable for any loss or damage caused by using or relying on AI-generated content

12. Third-Party Services

Our Service integrates the following third-party services. When using these features, you must also comply with the relevant third-party terms of service and privacy policies:

You can manage third-party service connection permissions through each platform's account settings at any time. Revoking third-party service authorization may affect your ability to use our Service.

13. Intellectual Property

Regarding ExamWise's intellectual property, please note the following:

  • Question Sources: The questions included in ExamWise come from past examination information publicly released by the Examination Yuan of the Republic of China (Taiwan). ExamWise does not claim copyright ownership of these question contents themselves
  • ExamWise Intellectual Property: ExamWise retains intellectual property rights to the following content:
    • Question explanations and detailed explanations
    • Knowledge card content
    • AI-generated visual explanations
    • Question categorization and tagging system
    • Software interface design and code
  • Usage Restrictions: Unless explicitly permitted by this agreement, these Terms do not grant you any rights to use ExamWise's intellectual property. You agree not to copy, modify, distribute, or commercially exploit ExamWise's proprietary content

14. Termination

We may terminate or suspend your access to the Service without prior notice or liability, including but not limited to situations where you violate these Terms. You may also voluntarily delete your account at any time to terminate use of the Service (see Section 9 "Account Deletion").

All provisions regarding termination of your access to the Service remain in effect after termination, including but not limited to ownership provisions, warranty disclaimers, indemnification, and liability limitations.

15. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without any express or implied warranties. ExamWise does not guarantee that the Service will meet your specific needs, does not guarantee uninterrupted, timely, or error-free service, and does not guarantee that service defects will be corrected.

16. Limitation of Liability

In no event shall ExamWise be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or other intangible losses, whether arising from use or inability to use the Service, any information obtained from the Service, or any other matter related to the Service, even if ExamWise has been advised of the possibility of such damages.

17. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of China (Taiwan). Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Taipei District Court, Taiwan, as the court of first instance.
